FortneyScott’s Legal Check for OFCCP Verification™ offers Federal Contractors privileged legal advice by experienced attorneys as to whether they can accurately verify their compliance with the obligations enforced by the U.S. Department of Labor’s Office of Federal Contract Compliance Programs (OFCCP).
What are the new verification obligations? Federal Contractors now must verify to OFCCP whether they have complied with their legal obligations and have “developed and maintained affirmative action programs at each establishment, as applicable, and/or for each functional or business unit." See 41 CFR Chapter 60. The verification obligation covers contractors’ extensive regulatory requirements, including the annual preparation of Affirmative Action Plans as well as compliance with employment practices regarding recruitment, hiring, promotions, compensation, record keeping, and workplace posters.
Why is legal advice on OFCCP verification necessary? The refusal to supply the required verification or the submission of false or misleading information may result in administrative or judicial enforcement proceedings against the Federal Contractor. It is essential that Federal Contractors confirm that they are meeting their regulatory obligations prior to submitting their mandatory verification responses. Securing legal advice in advance enables Federal Contractors to be confident that that their verifications are accurate.
How does FortneyScott’s Legal Check for OFCCP Verification™ support Federal Contractors’ new verification obligations? The new verification obligation requires all Federal Contractors, including subcontractors, to review each of their affirmative action programs to ensure that they are in compliance with all the regulatory requirements in 41 CFR Chapter 60.
FortneyScott’s attorneys used their significant experience in OFCCP compliance matters to develop Legal Check for OFCCP Verification™. For a fixed fee, Legal Check enables Federal Contractors to receive a privileged, legal assessment as to whether they are compliant with their OFCCP obligations. The Legal Check allows Federal Contractors to walk through each OFCCP-enforced nondiscrimination and affirmative action program obligation. After completing the survey, the Federal Contractor will be provided with a privileged, attorney consultation and a written report assessing the contractor’s compliance. The report will identify if there are any areas in which additional actions are recommended to achieve compliance. The Federal Contractor then can determine its next steps. FortneyScott is available to provide advice on those next steps if requested.
