Specifically, all employers must understand and address whether their Equal Employment Opportunity (EEO) and Diversity, Equity and Inclusion (DE&I) policies and programs are legal under the Trump Administration’s new compliance framework. Following President Trump’s Executive Order 14173, Ending Discrimination and Restoring Merit Based Opportunity, confirming that DE&I programs are legally compliant has never been more important.
Under the new obligations imposed by EO 14173, federal contractors must certify—subject to potential False Claims Act liability—that they “will not engage in illegal discrimination, including illegal DEI.” Additionally, all employers will be subject to heightened scrutiny as well as potential civil and criminal investigations for the use of “illegal” discrimination and preferences, including “illegal” DE&I programs.
